Agreement to Terms
By accessing or using the website of Bhairaveshwara Technology ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our website or use our services. These terms apply to all visitors, users, and others who access our services.
Our Services
Bhairaveshwara Technology specializes in the manufacturing of precision CNC milled components for aerospace, automotive, pharmaceutical, textile, railway, hydraulic systems, air compressors, submersible pumps, and plastic molding machinery industries. Our services include:
- Custom CNC milling and turning services
- Precision component manufacturing
- Contract assembly and parts kitting
- Supply chain management solutions
- Quality assurance and inspection services
Quotations and Orders
- All quotations provided by Bhairaveshwara Technology are valid for 30 days from the date of issue, unless otherwise specified in writing.
- Orders are considered binding only after written confirmation and acceptance of our quotation by the customer.
- We reserve the right to adjust pricing based on material cost fluctuations, design changes requested by the customer, or changes in order quantity.
- Minimum order quantities may apply for certain components and materials.
- Any specifications, drawings, or samples provided by the customer must be approved in writing before production begins.
Customer Obligations
- Provide accurate and complete technical specifications, drawings, or samples for manufacturing.
- Ensure that designs and specifications do not infringe upon any third-party intellectual property rights.
- Review and approve sample components (first article inspection reports) before full-scale production.
- Provide timely feedback and approvals to avoid production delays.
- Make payments as per the agreed payment terms and schedule.
Pricing and Payment
- Prices are quoted in Indian Rupees (INR) unless otherwise specified.
- Applicable taxes (GST) will be added to all invoices as per government regulations.
- Payment terms are typically 30% advance and 70% against delivery, unless otherwise agreed in writing.
- We accept bank transfers, cheques, and other payment methods as agreed upon.
- Late payments may incur interest charges at 2% per month or the maximum allowed by law.
- Ownership of goods remains with Bhairaveshwara Technology until full payment is received.
Delivery and Shipping
- Delivery timelines provided are estimates and not guaranteed unless specified as firm commitments.
- Shipping costs are borne by the customer unless otherwise agreed.
- Risk of loss or damage to products passes to the customer upon delivery to the carrier.
- We are not liable for delays caused by circumstances beyond our reasonable control (force majeure).
- Deliveries are made to the address specified by the customer in the purchase order.
Quality and Inspection
- All products undergo rigorous quality inspection using calibrated precision instruments.
- First article inspection (FAI) reports are provided for customer approval before bulk production.
- Our quality standards are aligned with ISO 9001:2015 processes and industry best practices.
- Customers have the right to inspect products at our facility before shipment, at their own cost.
- Any claims regarding quality defects must be reported within 7 days of receipt of goods.
Returns and Refunds
- Returns are accepted only for manufacturing defects or non-conformance to approved specifications.
- Return requests must be made within 7 days of delivery with supporting documentation.
- We reserve the right to repair, replace, or issue credit for defective products at our discretion.
- Custom-manufactured components cannot be returned unless they do not meet approved specifications.
- Refunds, if approved, will be processed within 15 business days.
- Return shipping costs are borne by the customer unless the defect is our error.
Intellectual Property
- All designs, drawings, specifications, and technical information provided by the customer remain the property of the customer.
- We respect customer intellectual property and will not share or use it for any other purpose without written consent.
- Any tooling, fixtures, or molds developed specifically for a customer's project remain our property unless paid for separately.
- Our manufacturing processes and methodologies are our proprietary intellectual property.
Limitation of Liability
To the maximum extent permitted by law, Bhairaveshwara Technology shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Delays caused by circumstances beyond our reasonable control
- Our total liability shall not exceed the amount paid by the customer for the specific product or service in question
Warranty
- We warrant that all products will conform to approved specifications for a period of 90 days from delivery.
- This warranty does not cover damage caused by misuse, improper handling, modification, or normal wear and tear.
- Our sole obligation under this warranty is repair, replacement, or refund of the defective product.
- Warranty claims must be submitted in writing with supporting evidence within the warranty period.
Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of business. This includes but is not limited to:
- Technical drawings, specifications, and designs
- Pricing and commercial terms
- Customer lists and business relationships
- Manufacturing processes and techniques
This confidentiality obligation survives the termination of our business relationship.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
Termination
We reserve the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use our services will cease immediately.
Changes to Terms
We reserve the right to modify or replace these Terms and Conditions at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
